Terms of Service

1. Acceptance of Terms

By accessing or using CloudGenticAI.com (the "Service"), operated by Forester Technology Corp. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

CloudGenticAI.com is a managed cloud hosting platform that provides subscribers with private, isolated containers running AI agent software (OpenClaw). The Service includes web chat, messaging channel integrations (Telegram, Discord, Slack, WhatsApp), file management, and the ability to connect your own AI provider accounts (Bring Your Own Key).

3. Accounts & Registration

  • You must be at least 18 years old to use the Service.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information when creating an account.
  • One account per person. Shared accounts are not permitted.
  • You are responsible for all activity that occurs under your account.

4. Subscriptions & Billing

The Service is offered on a monthly subscription basis. Pricing is displayed on our website and may change with 30 days' notice. All payments are processed securely through Stripe.

  • Subscriptions renew automatically each month unless cancelled.
  • You may cancel at any time through the Dashboard > Billing page.
  • Cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact support for refund requests.
  • We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Bring Your Own Key (BYOK)

The Service allows you to connect your own AI provider accounts (OpenAI, Anthropic, Google, etc.) using API keys or OAuth authentication.

  • Your API keys and OAuth tokens are encrypted at rest and used solely to power your AI agent.
  • You are responsible for any charges incurred on your AI provider account through your agent's usage.
  • We do not monitor, throttle, or modify requests made with your own credentials.
  • You must comply with the terms of service of any third-party AI provider you connect.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Generate, store, or distribute illegal content
  • Harass, abuse, or harm other individuals
  • Attempt to access other subscribers' containers or data
  • Perform unauthorized security testing or penetration testing
  • Use the Service for cryptocurrency mining or similarly resource-intensive activities
  • Resell or sublicense access to the Service without our written consent
  • Circumvent any technical limitations or security measures

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

7. Container Isolation & Data

Each subscriber's AI agent runs in an isolated container. We make commercially reasonable efforts to maintain isolation between subscribers. However:

  • You are responsible for the content stored in your container.
  • Containers and their data are destroyed when your subscription ends.
  • We do not guarantee backup of container data unless explicitly offered as a feature.
  • We may access your container for maintenance, security, or legal compliance purposes.

8. Intellectual Property

The Service, including its design, code, and branding, is the property of Forester Technology Corp.. Content generated by your AI agent using your credentials belongs to you, subject to the terms of the underlying AI provider. OpenClaw is open-source software used under its respective license.

9. Limitation of Liability

To the maximum extent permitted by law, Forester Technology Corp. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation of the Service.

11. Indemnification

You agree to indemnify and hold harmless Forester Technology Corp. from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Sections regarding liability, indemnification, and intellectual property survive termination.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
